Should I Contact my Insurance Company Before, or After, I Contact an Attorney?

Even if you are planning to hire an attorney, it is generally a good idea to contact your insurance company as soon as possible after a car accident. Your insurance policy likely includes a provision that requires you to report the accident within a certain time frame. Failure to report an accident within the specified time frame in your policy could lead to a delay in your coverage, and even to a cancellation of your auto policy.

That being said, it is best to speak with an attorney—one who you trust to handle your case—prior to speaking with an insurance adjuster. Hiring an attorney as soon as possible can help ensure that you have the best opportunity to obtain a fair settlement. An attorney can advise you on your rights and legal options, as well as how to proceed with reporting an insurance claim. Furthermore, an attorney can help you better understand your policy, including any limitations that may apply to your case.

If you are not able to consult with an attorney prior to speaking with an insurance company, it is critical to speak to your insurance adjuster with caution. For example, you should not admit fault or make statements that could be later used against you. Ideally, your attorney should review your written statements prior to speaking with the insurance adjuster.

Do I still need to report the accident to my insurance company if the accident is the other driver’s fault?

Even if you believe that you are not at fault for a car accident, you still need to call your insurance company and tell them what happened. Because Florida is a “no-fault” state, you will likely use your Personal Injury Protection (PIP) coverage to cover up to $10,000 of your initial medical bills and loss of earnings. Additionally, in the event that the at-fault driver’s coverage is limited, and cannot cover your damages, you may want to use your underinsured or uninsured motorist coverage from your policy to be compensated for your injuries and losses.
